Self-Regulatory Body Refers DRTV Marketer

An independent self-regulatory organization launched by the Electronic Retailing Association referred a DRTV marketer of a dietary supplement to the Federal Trade Commission yesterday.

Basic Research LLC, Salt Lake City, failed to substantively address questions about “core claims” made in its advertising for the supplement Zantrex-3, according to a statement from the Electronic Retailing Self-Regulation Program.

Though ERA was instrumental in starting the program, it is run independently by the National Advertising Review Council, a joint operation supported by ad industry groups and the Better Business Bureau.

Basic Research has caught the FTC's attention in the past. In June, the FTC filed a complaint with an administrative law judge against Basic Research and several of its related corporations. The complaint charged them with making false and unsubstantiated claims about six of their other weight-loss products. The case remains pending.
