FTC Sues Auto Additive Marketer

The Federal Trade Commission this week sued Speedway Motorsports Inc., Conrad, NC, charging that the company made false claims and doctored scientific evidence as part of an infomercial campaign touting an automobile additive.

The suit, filed in U.S. District Court in Greensboro, NC, claimed that the company's infomercials promoting ZMAX auto additives made unsubstantiated claims regarding the product's capabilities. The FTC said Speedway Motorsports eliminated negative results from a 1997 independent laboratory test it cited in an infomercial.

The infomercials offer consumers a package of three auto additives for $39, according to the FTC. Speedway Motorsports, which operates several NASCAR racetracks, denied the charges and said it remains confident in its product. “Today's action by the FTC is without merit,” said Marylaurel E. Wilks, the company's vice president of communications.
