Three companies failed to cooperate with the Direct Marketing Association’s Committee on Ethical Business Practice to resolve complaints, the DMA said yesterday. In addition, one company was referred to the Federal Communications Commission for possible action.
None of the three companies are DMA members.
The committee has 15 executives from DMA member companies who investigate offerings made throughout the direct marketing field based on complaints and inquiries. The DMA’s Teleservices Ethics Committee investigates telemarketing-related complaints. From July to November, the two DMA committees heard 20 cases, six of which were on general advertising, including offline and online promotions, six on telemarketing practices and eight on collection and use of marketing data.
The DMA said SND Marketing Listing Service, Spring, TX, did not respond to the committee’s concerns about its solicitation, alleged to appear in the guise of an invoice, and of faxing its promotion, which is contrary to federal law.
Intelius, Bellevue, WA, is an online reference service that locates individuals. The ethics committee alleged that the company failed to confirm that its information sources don’t include marketing data, or whether and how consumers can remove their names from the service.
Incentive Reward Center, Delray Beach, FL, now known as Consumer Incentive Promotions, initially responded to the committee but did not continue to cooperate with it in explaining its online offer for free merchandise.
