Missouri Sues Miss Cleo, Alleges DNC Violations

The Missouri attorney general's office has filed a lawsuit against the operators of the Miss Cleo psychic hot line — famous for late-night direct response TV ads — alleging violations of the state's new do-not-call list.

Access Resource Services Inc. committed 94 violations of the law, the attorney general's office charged. Each violation carries up to a $5,000 fine.

Missouri attorney general Jay Nixon also accused the company of billing consumers — including some dead people — without consent. Access Resource Services also illegally billed for calls made by minors without parental consent, even though its services are advertised as being for people older than 18 only, the lawsuit charged.

“Miss Cleo should have seen this coming,” Nixon said in a statement.

An attorney for Access Resource Services, Fort Lauderdale, FL, told The Associated Press that the state has no basis for the lawsuit. He said the company wanted to work with Nixon's office to demonstrate the propriety of its marketing practices.

Access Resource Services also faces a lawsuit from the attorney general of Pennsylvania charging that it wrongly billed customers. The company has settled a similar lawsuit with Florida.
