Judge Denies BellSouth Injunction

BellSouth rival Access Integrated Networks announced last week that a U.S. District Court in Atlanta declined to issue an injunction against the company in connection with what BellSouth called a misleading telemarketing campaign.

On Aug. 5, BellSouth sought a restraining order against Macon, GA-based Access, accusing its competitor of claiming a false affiliation with BellSouth in telemarketing pitches and giving false information about the supposed “break-up” of BellSouth. Access blamed the problems on a telemarketing contractor, which it suspended.

Judge Willis Hunt ruled that because the misleading telemarketing activities had been stopped, an injunction was unnecessary, according to Access. A BellSouth spokesman said the company was preparing a statement in response to the judge's decision as of press time.
