Infomercial Marketer Settles FTC Charge

Amden, which markets the Cybersonic toothbrush kit in long-form infomercials as well as the Internet, agreed to pay $28,000 to settle charges that it failed to ship products in as timely a fashion as promised, the Federal Trade Commission said Friday.

According to the charges, Amden claimed that products for customers paying in installments would ship in three to four weeks and in 10 days for customers paying in full. Amden failed to ship the products within the promised time and failed to notify customers of the delay and allow them to request refunds, the FTC charged.

In addition to paying a cash penalty, Amden, San Juan Capistrano, CA, must file a compliance report with the FTC within 120 days.

Amden markets the Cybersonic Complete Sonic Oral-Care System, which includes interchangeable brushing, flossing and tongue-cleaning head, via 30-minute infomercials. The product is available for $120, payable in full or in five monthly installments.
