Indiana sued five Florida-based businesses and at least three individuals accused of making hundreds of sales calls to people registered on the state’s do-not-call list, Indiana Attorney General Steve Carter said yesterday.
The prerecorded calls promoted vacation packages from Vacation Depot, USA Travel and Premier Travel, according to officials. More than 670 complaints were filed about the calls, which originated from Gome Enterprise Inc., Funco Resorts Inc., Total Marketing Group Inc., JNS Design Group Inc., Zfone VoIP Inc., Anthony Digiacomo, Enrique Gomis and Mikael Schultz, plus other unnamed defendants.
The state said the violations of the state’s DNC law and the national Telephone Consumer Protection Act started in July 2004. The defendants “have been evasive and uncooperative” in settling, the attorney’s general office said.
The companies could face a fine of up to $25,000 for violation of the DNC law and up to $1,500 for each violation of a federal law limiting prerecorded messages.
This is Indiana’s second lawsuit against a company involving a DNC violation. In August, Gabriel Gouvas was ordered to pay $100,000.
