DMD Conferences LLC has filed a motion to dismiss a lawsuit by Courtenay Communications for breach of contract and other causes regarding a proposed sale of the DM Days in New York Conference.

DMD’s grounds include that a confidentiality agreement signed by both parties Oct. 23, 2001, bars any action against DMD, chairman L. William Black or any of its board members. Adrian Courtenay, founder/CEO of Courtenay Communications, opposed the motion in an affidavit that contained 25 exhibits, including some signed by Black.
The motions were submitted Jan. 10 to New York Supreme Court Justice Charles Ramos, but a decision is not expected for months. Courtenay’s suit asks for $5 million in damages.
The DM Days conference is set for June 2-4 at New York’s Jacob K. Javits Convention Center. It conflicts with the 19th Annual Catalog Conference in San Francisco on June 1-3.
