Cap One, USPS still in NSA dispute

An ongoing dispute between the post­al service and Capital One regarding a negotiated service agreement (NSA) — a contract between the USPS and the mailer that provides customized pricing incentives — is still in the discovery phase.

Capital One filed a complaint with the Postal Regulatory Commission on June 19 claiming that it was denied an NSA under the same terms as one approved to Bank of America Corp.

As of last week, both sides were still questioning witnesses and requesting documents for evidence. There is no time limit to how long this phase can last, said a spokesperson for the PRC, which will decide the case.

The USPS claims Capital One’s pro­posed NSA was not identical to that of Bank of America, and that the bank had not exhausted all good faith negotiations for an NSA before filing the complaint. n
