Virginia Delegates Delay Consideration of DNC List

A Virginia House of Delegates committee indefinitely postponed consideration of a proposed statewide do-not-call list. The bill, H.B. 2462, proposed by state Rep. George Grayson, D-Williamsburg, would allow Virginia consumers to sign up for a state DNC list for a $10 fee and a $5 annual renewal fee.


The American Teleservices Association -- which was represented by Jim Newell of Collegiate Funding Services, Fredericksburg, VA -- argued that state DNC lists duplicate federal laws requiring telemarketing companies to maintain their own inhouse DNC lists. A state DNC list is an expensive way to limit telemarketing calls, Newell told the House Committee on Corporations, Insurance and Banking.


Another bill before the House of Delegates, H.B. 2427, would give consumers the right to sue companies for violating state telemarketing laws. The bill, which the ATA supports, has been passed out of committee for a vote by the full House of Delegates.


Several major corporate ATA members, including America Online, Capital ONE, Nextel and IBM, are headquartered in Virginia.


Thirteen states, including New York and Florida, have passed DNC list laws. Twenty-six states -- including Virginia, California, New Jersey and Texas -- are considering DNC list legislation.
