Indiana Files First DNC Lawsuit

The Indiana attorney general filed a civil complaint yesterday against a local man who sold satellite television services via telemarketing in the state's first lawsuit to enforce its no-call list.


Indiana Attorney General Steve Carter sued Gabriel Gouvas of Madison County on allegations that Gouvas made unsolicited telemarketing calls to numbers on the state no-call list and refused to comply when contacted by the state. Carter seeks a court order to immediately close Gouvas' business.


Consumers in 10 Indiana counties have filed 60 complaints against Gouvas, who did business as Spectrum Services and Digital Communications, according to the attorney general's office. Gouvas has not responded to an offer for a negotiated settlement.


Though this case marks the first lawsuit alleging no-call violations, Indiana has settled allegations of no-call violations out of court and taken $500,000 in penalties from business out of court. Indiana maintains its own no-call list separate from the federal list.
