FCC Seeks Comment on Telemarketing Preemption Petition

The Federal Communications Commission began accepting public comments last week on an industry petition to preempt state laws that affect interstate telemarketing.

The American Teleservices Association and the Direct Marketing Association are among 33 industry groups and members supporting the petition, which asks the FCC to declare that federal law will be the lone standard for the regulation of interstate telemarketing. Telemarketers contend that the explosion of sometimes-conflicting state telemarketing laws has made compliance difficult and expensive.

Comments can be filed electronically at www.fcc.gov/cgb/ecfs/ under proceeding 02-278. State attorneys general oppose the preemption of state telemarketing laws and have organized consumer write-in campaigns to oppose such proposals.
