Judge Dismisses Lawsuit Against DM Days Sellers

DM News has learned that New York State Supreme Court Justice Charles Ramos has dismissed a breach of contract lawsuit filed by Courtenay Communications Corporation, the owner of this paper, against the former owners of the DM Days in New York Conference, which was sold earlier this year to the Direct Marketing Association.


Courtenay had argued that a firm deal to purchase the show had been reached and confirmed in writing between DMD Conferences and Courtenay Communications. In their motion to dismiss the case, the defendants argued that provisions of a signed confidentiality agreement enabled the DM Days owners to terminate discussions with CCC or to negotiate or enter into a written agreement with another party without prior notice.


CCC president Adrian Courtenay said he is disappointed with the decision and is considering an appeal.
