Gateway Files 2nd Lawsuit Against Web America

Computer direct seller Gateway Inc., Sioux City, SD, filed a second lawsuit against its original Internet service provider Web America Inc., alleging that the Dallas-based ISP infringed on Gateway's trademarks by continuing to use Gateway's logo and Holstein-cow design after Gateway sued to terminate the two companies' service contract.


The second lawsuit comes after Web America, which provides e-mail, online access and other Internet services for customers of gateway.net, and Gateway filed suits against each other over issues related to Gateway's efforts to terminate its exclusive contract with Web America and launch a new contract with another ISP.


Douglas Kennedy, a spokesman for Web America, said the company believes both of Gateway's suits are without merit.


"We continue to service Gateway subscribers," he said. "We still have a contract."


The contract called for Web America to provide Internet services to gateway.net customers using Gateway logos and trademarks.
