FCC Establishes No-Call Enforcement Team

The Federal Communications Commission has created a team of attorneys and investigators who will be assigned to enforce the national no-call list, which took effect Oct. 1, the agency said yesterday.


According to the FCC, the agency received about 250 complaints from consumers about telemarketing practices the day the no-call list took effect. The FCC has said that it plans to enforce the list despite a ruling by Judge Edward W. Nottingham of U.S. District Court in Denver that the list is unconstitutional.


Kurt Schroeder, deputy chief of the FCC Enforcement Bureau's telecommunications consumers division, will lead the enforcement team, the FCC said. The team also will enforce the FCC's other new telemarketing rules, including limits on predictive dialers.


The Federal Trade Commission, which runs the no-call database, has been prevented from enforcing its own no-call rules due to Nottingham's decision. The 10th Circuit Court of Appeals is considering the FTC's request that it be allowed to enforce those rules while the courts settle legal issues related to the no-call list.
