EarthLink Settles With 'Alabama Spammers'

EarthLink settled a lawsuit this week with two men accused of being part of a spam ring, the company said.


The men paid an undisclosed amount to settle the lawsuit and agreed to stop sending unsolicited e-mail, EarthLink said.


EarthLink, Atlanta, filed a lawsuit in U.S. District Court in Atlanta in February 2004 against Damon DeCrescenzo and David Burstyn, accusing them of being part of the "Alabama Spam Ring" operation that sent 250 million illegal e-mails.


The two are accused of using phone lines in and around Birmingham, AL, to send the spam, earning them the nickname "Alabama Spammers."


EarthLink's complaint alleged the group used stolen credit cards to create Internet accounts to send spam hawking Viagra, herbal supplements, adult matchmaking services and spamming software. The group used aliases, phony addresses and nonexistent corporate identities. They directed people to dynamically hosted Web sites that would disappear after advertising a product.


EarthLink has been active in the fight against spam, launching several Internet tools to thwart unwanted e-mail and filing several lawsuits. The company this month endorsed Georgia Gov. Sonny Perdue's proposal to make spamming a felony in the state.
